Representative Gray, prime sponsor, presented House Bill 22-1119, concerning civil liability for presenting false claims for payment to the state. The committee heard testimony on the bill at its March 15 meeting. Representative Gray explained the effect of amendments L.002 (Attachment A) and L.003 (Attachment B). Jefferey Riester and Jan Zavislan, representing the Department of Law, responded to questions about the amendments.

HB22-1321 - Amended, referred to House Appropriations

Representatives Robert and McKean, prime sponsors, presented House Bill 22-1321, concerning a study of devices that are based on FDA-cleared technology capable of self-assessing impairment of motorists to detect the presence of drugs other than alcohol during roadside sobriety investigations. Representative Roberts explained the effect of the bill and discussed its need. Representative McKean provided further input on the merits of the legislation. Representative McKean responded to questions regarding how devices referenced in the bill will help determine marijuana intoxication. Representatives Roberts and McKean responded to questions regarding the reasons for commissioning a study under the bill.

Bia Campbell, representing VS Strategies, testified in support of the bill.

Mike Honn, representing the Colorado State Patrol, testified in support of the bill. Ms. Campbell responded to questions regarding how many drug-detecting devices will be subject to study under the bill, how such devices work, and the baseline for cognitive functioning used by these technologies. Discussion ensued regarding privacy concerns with the study commissioned by the bill, and the cost for the study. Discussion followed regarding whether the company charged with conducting the study has already been determined.

Mr. Conrad responded to questions regarding demographic diversity among the subjects of the study commissioned by the bill. He also addressed privacy-related questions raised during earlier testimony.

SB22-055 - Referred to House Appropriations

Representatives Roberts and McKean, prime sponsors, presented Senate Bill 22-055, concerning increased alcohol monitoring for impaired driving offenders. Representative Roberts explained the effect of the bill and discussed its need. Representative McKean further discussed the bill's necessity and merits. Representative Roberts responded to questions regarding whether someone under continuous alcohol monitoring will be required to use an interlock device under the bill, and probation requirements under the bill.

Discussion ensued regarding the number of repeat driving under the influence (DUI) cases that take place during the one-month period a license is revoked for DUI.
