Kennedy, prime bill sponsor, presented Senate Bill 23-176, concerning measures
to improve outcomes for individuals with an eating disorder.  The
bill creates prohibitions and requirements related to health care services
for individuals with disordered eating, including:




- prohibiting
Medicaid, starting July 1, 2023, and health insurance plans, starting January
1, 2024, from using body mass index, ideal body weight, or any achieved
weight standard to determine medical need or the level of care for individuals
with disordered eating; and




- prohibiting
retail establishments from selling over-the-counter diet pills to individuals
under 18-years-old without prescriptions, with rules to be created by the
State Board of Pharmacy within the Department of Regulatory Agencies.

the disordered eating prevention program in the Department of Public Health
and Environment.  The bill creates the Disordered Eating Prevention
Program and a research grant program within the Department of Public Health
and Environment to better understand the risk factors, impacts, and interventions
associated with disordered eating.

SB23-284 - Referred to the Committee of the Whole

Representative Jodeh and Representative Weinberg, co-prime bill sponsors, presented Senate Bill 23-284, concerning requirements for contraception insurance coverage that increases consistent access to the contraception most suited to the individual. Under current law, state-regulated insurance plans must cover a 3-month supply of contraceptives the first time the prescription is filled and a 12-month supply for refills. The bill requires state-regulated insurance plans to cover a 12-month supply of all FDA-approved contraceptives, or their therapeutic equivalent, when permitted by the prescription and supply, without imposing prior authorization requirements. The bill specifies that dispensing fees must be paid per unit. Additionally, the plan must include point-of-sale coverage for over-the-counter contraceptives without requiring a prescription, prior authorization, or step therapy. The Commissioner of Insurance must establish corresponding reporting requirements.
