The committee began a discussion of HB 18-1103 without the sponsor present.  Under current law, local governments may enact an ordinance or resolution requiring off-highway vehicle (OHV) operators to have a driver license or carry liability insurance within an entity's jurisdiction.  This bill clarifies that local governments may also require OHV operators to use seatbelts, a child restraint system, eye protection, or a helmet (for riders 18 years and younger).  A local government may also limit the number of occupants on an OHV to the maximum number of occupants the vehicle is designed to hold.

Eric Bergman, representing Colorado Counties, Inc., and the Colorado Municipal League, testified in support of the bill. He provided two handouts [Attachment A] and [Attachment B]. Mr. Bergman responded to questions from the committee. He explained the purpose of amendment L.003 [Attachment C].
