The committee was called to order. A quorum was present. Representatives Navarro and Gray, co-prime sponsors, presented House Bill 17-1043, which extends a SMART Act reporting requirement for the Department of Public Safety (DPS) through 2018. Under current law, DPS must report on the activities of the Colorado Fraud Investigators unit annually through 2017. The bill also extends a $4 surcharge on uniform commercial code filings to June 30, 2018. Representative Gray addressed questions from the committee about the estimated fiscal impact of the bill.

Mr. Ralph Gagliardi, representing DPS, testified in support of the bill and responded to earlier questions raised by the committee. He also responded to questions from the committee about the number of FTE employed in the fraud unit, various filing fees, and how the department works with private vendors to conduct some business. Representative Navarro also responded to committee questions.

Ms. Jenifer Waller, representing the Colorado Bankers Association, testified in support of the bill. In response to a question, Ms. Waller said she thinks the reporting requirement and surcharge should be extended for more than a year.

Mr. Griesmer and Representative Navarro responded to additional questions from the committee. Discussion ensued on the use of the fee and the future of the Fraud Investigation Unit.
