Representative Titone and Representative Ortiz, co-prime bill sponsor, presented House Bill 22-1031, concerning a requirement that a powered wheelchair manufacturer facilitate the repair of its powered wheelchairs by providing certain other persons with the resources needed to repair the manufacturer's powered wheelchairs. The bill outlines requirements for manufacturers of powered wheelchairs to provide documentation and tools to independent repair providers, and creates a deceptive trade practice for failure to abide by these requirements. Representative Titone provided a handout to the committee (Attachment A).

Representative Ranson, bill sponsor, presented House Bill 22-1271, concerning ensuring personal rights of protected persons through required duties of guardians. The bill establishes rights for people protected through a legal guardianship and places requirements on the guardians of protected persons and wards, including notification requirements for family members and creation of initial care plans. These rights generally include and address communication responsibilities, including notification to family members, persons of court record, and other designees within seven days when the ward or protected person:

  • changes residence;
  • resides at a location for more than 48 hours that is different than their official residence;
  • is admitted for acute or emergency medical care; or
  • dies.

HB22-1256 - Amended, referred to House Appropriations

Representative Amabile and Representative McCluskie, co-prime bill sponsors, presented House Bill 12-1256 concerning modifications to civil involuntary commitment statutes for persons with mental health disorders. The bill makes numerous changes to the state’s involuntary commitment system, including transfers duties relating to the care and treatment of persons with mental health disorders from the Office of Behavioral Health to the Behavioral Health Administration in the Department of Human Services. It creates new procedures relating to 72-hour treatment and evaluation of a person appearing to have a mental health crisis, as well as procedures to certify short-term or long-term care and treatment of a person who has a mental health crisis. The bill also outlines processes for engaging with an individual that may be experiencing a behavioral health crisis including transport, oversight, care, and access to legal representation.
