Senator Cooke, sponsor, presented House Bill 16-1190, concerning the use of deadly force in a detention facility. Senator Cooke explained the purpose of the bill, which amends the existing "Make My Day" law.

Undersheriff Joe Breister, representing the El Paso County Sheriff's Office and the County Sheriffs of Colorado, testified in support of the bill. He explained that the bill would protect those working in correctional facilities and offenders incarcerated in those facilities.

Mr. Jay Kirby, representing the Colorado Department of Corrections (DOC), testified in support of the bill. Mr. Kirby stated that the bill would permit the DOC to be involved with certain prosecutions regarding events in correctional facilities.

Ms. Brittny Lewton, District Attorney for the Thirteenth Judicial District, testified in support of the bill. Ms. Lewton discussed a situation in which the existing law amended by HB 16-1190 was used by inmates as a defense in a criminal prosecution.

Mr. James Bullock, District Attorney for the Sixteenth Judicial District, testified in support of the bill. Mr. Bullock stated that he has chosen not to prosecute certain cases based on the existing law.
