Senator Zenzinger, sponsor, presented Senate Bill 17-085 to the committee. Under current law, county clerk and recorder offices are authorized to collect a $3 surcharge for each recording or filing the county receives. Beginning January 1, 2018, the bill increases the surcharge by $4 per document, to be deposited in the newly created Statewide Attainable Housing Investment Fund (fund). The fund is created in and administered by the Colorado Housing and Finance Authority (CHFA). Of the moneys in the fund, up to 25 percent must support new or existing programs that assist households earning an income of up to 80 percent of the area median income with financing, purchasing, or rehabilitating single family homes. Programs can include those making loans to such households for specified purposes.

Senator Fields, sponsor, presented Senate Bill 17-118 to the committee. Under current law, private occupational schools (schools) are required to provide program offerings and a schedule of tuition and fees to students. The bill expands the required information and requires that schools annually collect this information for each campus or location, and provide it to prospective students and the Department of Higher Education (DHE). The bill allows the Private Occupational School Board in the DHE to prescribe policies and procedures to collect the required information and determine on a case-by-case basis if the required information is unavailable or that the time frame for the disclosure is unreasonably burdensome. The bill requires that DHE use the information collected from schools to populate a free, online, comparative tool no later than July 1, 2018. Schools must provide any additional information required by DHE to populate the comparative tool, including student-level records that may help determine transfers and employment information. As part of its SMART Act hearing prior to the start of the 2018 and 2019 legislative sessions, DHE must report on the implementation of the bill.

Senator Merrifield, sponsor, presented Senate Bill 17-107 to the committee. Under current law, the Colorado Department of Education (CDE) determines the level of attainment of each public school, each school district, the Colorado Charter School Institute, and the state as a whole based on four performance indicators:



• student academic growth;

• student achievement on statewide assessments;

• progress made in closing growth and achievement gaps; and

• postsecondary and workforce readiness.



These indicators form the basis of the state's public school accountability and accreditation system. Beginning with the 2017-18 academic year, this bill requires that the CDE also consider access to courses or educational programs in the arts as a performance indicator. The bill requires that the State Board of Education adopt rules for awarding performance credit to schools and districts for arts offerings. In determining the amount of additional credit, the board must also take into account a district's or school's geographic location, and the percentage of enrolled students who qualify for free or reduced price meals. Schools and districts are required to report to the CDE the courses or programs they provide in the arts, and make assurances to the department that those courses meet or exceed applicable academic standards.

This bill requires each school district that has obtained voter approval to retain and spend revenue in excess of its TABOR limit to restore the district's total program mill levy, over the course of five years in equal increments, to the number of mills levied in the property tax year immediately preceding the year in which the school district received voter approval (target level). A school district is not allowed to levy a mill that exceeds the school district's total program as calculated before application of the negative factor.

Senator Fenberg, sponsor, presented Senate Bill 17-147 to the committee. No later than December 31, 2017, this bill requires that the Department of Personnel and Administration (DPA) develop and distribute informational materials concerning federal student loan forgiveness programs. This information must include:



• a summary of the federal public service loan forgiveness program, the teacher loan forgiveness program, and other federal student loan repayment programs;

• eligibility requirements;

• steps an eligible employee must take to participate in these programs;

• a recommendation that employees contact their student loan servicer for additional information; and

• answers to frequently asked questions.



In lieu of developing the materials, the DPA may provide materials published by a federal agency that include the required information. The DPA is required to make the materials available on the department's website, verify the accuracy of the information at least annually, update the information as necessary, and distribute the materials to the following entities:



• the Colorado Department of Education, for distribution to school districts, the Charter School Institute, and Boards of Cooperative Educational Services;

• the Department of Higher Education, for distribution to the governing boards of state supported institutions of higher education;

• the Secretary of State, for distribution to nonprofit public service organizations; and

• the Division of Local Government in the Department of Local Affairs for distribution to counties, municipalities, and special districts.



School districts, charter schools, and institutions of higher education are required to make the materials available for their employees, nonprofit service organizations and local governments are encouraged to do so.
