The committee exited executive session.

Representative Bacon noted that the committee had made findings on the complaint at a previous meeting, and explained that this was the first time that the House Workplace Harassment Committee has recommended corrective actions.  The members of the committee commented on the complaint and the recommended corrective actions.

Motion I move that the committee recommend this range of corrective actions: removal from all committee assignments except for one, per House Rule 25 (b); that the one committee not be one that includes a complainant; removal of all aide hours; that physical office and floor seating not be in close proximity to any of the complainants; that the respondent takes workplace harassment training; to the extent practicable, that the respondent not be in close proximity to any of the complainants; that the respondent provides a formal, written apology to be published in the journal; and that the respondent be informed that persistent behavior or behavior deemed to be considered retaliatory may result in more severe sanctions including an expulsion resolution; further, that these recommendations be implemented in whole and that the duration last as long as the complainants are employees at the state Capitol; finally, that the committee recommends that a formal censure vote be taken by the House of Representatives to condemn the harassing behavior that fails to uphold the honor and dignity of the Colorado House of Representatives.

Representative Soper asked Mr. FitzSimons to comment on whether the respondent will be publicly named. Mr. FitzSimons explained that the committee will provide a summary of its findings and its recommended actions to House leadership. The summary will include the name of the respondent, but no other individuals.

Mr. FitzSimons explained that House leadership is responsible for implementing the actions recommended by the committee. If the leadership deviates from the recommendations, leadership must justify those deviations to the committee in writing. If the committee disagrees with leadership's actions, it can make public the reasons for the disagreement. The committee designated Chair Bacon and Vice-Chair Soper to work with Mr. FitzSimons to prepare the committee's written summaries and recommendations.
