Senator Mullica, primary bill sponsor, introduced Senate Bill 26-007, which requires health facilities to allow terminally ill patients who are registered with the state medical marijuana program to use their medical marijuana while admitted to or residing in the facility. Medical marijuana use under these conditions is restricted to products that do not involve smoking or vaping and complies with the prescribing doctor’s recommended use. Health facilities must record and document the patient’s medical marijuana registry card, develop written guidelines for use within the facility, and determine a manner of storage that ensures the safety of other patients and facility operations. Facilities and their employees are not liable for conduct performed in compliance with the requirements of the bill; however, a facility may suspend compliance if required by federal law.
